Will the push for recognition of Indigenous rights lead to a fracturing of the rule of law and societal cohesion? The current legal framework treats Indigenous peoples as a distinct group with special rights. Prof. Pardy looks at how this undermines the principle of equality before the law and why recognizing different identities perpetuates divisions, which he argues is a fundamental error in addressing land claims and rights. The culture in Canada has evolved into a new, mixed identity, he says, and the law should reflect this reality rather than cling to outdated notions of separate peoples.
